These Terms and Conditions govern your use of the Pensaria website located at pensariaad.pro and your engagement with any of our organisational reading and document services. By accessing this website or booking a session, you agree to these terms in full.

Pensaria is registered in Malaysia and operates under Malaysian law. If you do not agree with any part of these terms, please do not use this website or engage our services.

1. Definitions

• "Pensaria", "we", "us", "our" — Pensaria, operating from 17 Persiaran Greentown 3, Greentown Business Centre, 30450 Ipoh, Perak, Malaysia.
• "You" / "User" — any person who accesses this website or enquires about or books any service.
• "Services" — the three organisational reading and document-mapping programmes described on this site: the Single-Session Records Map, the Group Reading Series, and the Household Records Programme.
• "Content" — all text, documents, reading materials, and records-folder materials produced or distributed in the course of our sessions.
• "Agreement" — these Terms and Conditions, together with our Privacy Policy and Cookie Policy.

2. Acceptance of Terms

Use of this website constitutes acceptance of these terms. Booking a session requires that you have read and understood this Agreement in full.

Our services are available to adults aged 18 and above. By submitting an enquiry or booking, you confirm that you have the legal capacity to enter into a binding agreement under Malaysian law.

We reserve the right to decline any booking at our discretion, without obligation to provide a reason.

3. Service Description

Pensaria offers three document-organisation services aimed at retirees and households in Malaysia:

• Single-Session Records Map — a three-hour one-on-one session producing a personal records map (RM 490)
• Group Reading Series — four reading sessions over four weeks, focused on publicly available retirement documentation (RM 1,650)
• Household Records Programme — a year-long programme of five sessions supporting a structured household records system (RM 4,380)

All sessions are organisational in nature. None of our services constitutes financial advice, legal counsel, tax guidance, or any regulated professional service. We do not interpret documents in the context of any individual's personal, financial, or legal situation.

Services are delivered in Ipoh, Perak, Malaysia or by arrangement. We do not offer international delivery of services. Availability is subject to scheduling and may vary without notice.

4. User Responsibilities

When using this website or our services, you agree to:

• Provide accurate and complete information in enquiries and bookings
• Attend scheduled sessions at the agreed time, or provide adequate notice of any change
• Use session materials and reading packs for personal, non-commercial purposes only
• Not record, reproduce, or redistribute session content without written permission
• Treat session facilitators and other participants with respect

Prohibited uses of this website include scraping content, transmitting malicious code, misrepresenting your identity, or using the site for any unlawful purpose.

5. Intellectual Property

All original content on this website — including text, layout, and design — is the intellectual property of Pensaria or its contributors, protected under Malaysian copyright law.

Reading packs distributed during sessions consist of publicly available reference material and are compiled by Pensaria for organisational use within sessions. The compilation and formatting is proprietary.

You are granted a personal, non-transferable, non-exclusive licence to read and use session materials for your own organisational purposes. No other use is permitted without written consent from Pensaria.

6. Payment Terms

All prices are quoted in Malaysian Ringgit (RM) and are subject to change. The price applicable to your booking is confirmed at the time of booking confirmation.

Refund Policy

• Cancellations made more than 7 days before a session: full refund
• Cancellations made 3–7 days before a session: 50% refund
• Cancellations made fewer than 3 days before a session: no refund, but rescheduling may be arranged at our discretion
• Sessions cancelled by Pensaria will result in a full refund or rescheduling at your preference

Payment methods accepted are confirmed at booking. We do not store payment card details on our systems.

7. Service-Specific Terms

Single-Session Records Map

The session produces one records map document. The scope of the session is limited to mapping document locations and identifying gaps in publicly available reference materials. No legal, financial, or advisory output is produced.

Group Reading Series

Participants are expected to attend all four sessions. The reading pack is distributed at the first session and is for participants only. Group session content is not recorded or distributed.

Household Records Programme

The programme is delivered over 12 months. Check-in session scheduling is by mutual agreement. The records folder delivered at programme close is the client's property. Pensaria retains no copies of client documents.

8. Disclaimers

This website and our services are provided on an "as is" basis. We make no representations about the completeness, accuracy, or suitability of content for any particular purpose.

Pensaria is not a financial adviser, legal firm, or licensed professional service provider. Nothing on this website or in our sessions constitutes advice of any kind. All reference materials shared are publicly available documents; any interpretation of those materials in relation to an individual's circumstances is the reader's own responsibility.

We do not guarantee any particular outcome from our organisational sessions. The usefulness of a records map or reading session depends on information you bring to it.

9. Limitation of Liability

To the maximum extent permitted by Malaysian law, Pensaria shall not be liable for any indirect, incidental, or consequential loss arising from your use of this website or our services.

Our total liability in connection with any one booking or service is limited to the fee paid for that booking.

This limitation does not apply where liability cannot be excluded by law, including in relation to death or personal injury arising from negligence.

10. Termination

Either party may end a service arrangement by written notice. Where a client terminates a multi-session programme, the refund policy in Section 6 applies to any sessions not yet delivered.

Pensaria may suspend or terminate services if a client behaves in a manner that disrupts sessions, misrepresents their circumstances, or breaches these terms. In such cases, a pro-rated refund for undelivered sessions will be offered.

11. Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from your use of this website or our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

Before initiating any formal proceedings, both parties agree to attempt informal resolution. Please write to [email protected] with a description of your concern. We will respond within 14 business days.

Consumer protection matters may also be referred to the Tribunal for Consumer Claims Malaysia (Tribunal Tuntutan Pengguna Malaysia).

12. General Provisions

• Entire Agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the full agreement between you and Pensaria concerning your use of this site and services.
• Severability. If any provision is found unenforceable, the remaining provisions continue in full effect.
• Waiver. Failure to enforce any provision is not a waiver of the right to do so later.
• Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours in connection with a business reorganisation.
• Notices. Formal notices to Pensaria should be sent by email to [email protected] or by post to our Ipoh address.

13. Changes to These Terms

We may update these Terms to reflect changes in our services, business practices, or the law. The "Last updated" date at the top of this page will reflect the most recent revision.

For users who have an active booking at the time of a material change, we will communicate the change directly before it takes effect. Continued use of the website after changes are posted constitutes acceptance.
